Frequently Asked Questions

Prosecuting Solicitors Office

Why have you picked on me and my company when I know of other companies who have 'got away with it' for years?

Our computer system automatically identifies companies that fail to deliver their accounts or annual returns on time. If you are aware of any companies that are late in delivering these documents, we would be pleased to receive the details. We can take action to prosecute on the first day of default but our overriding aim is to obtain the overdue document(s) rather than prosecute.

Why do you prosecute small companies?

All companies, large and small, have a responsibility to file accounts and annual returns on time. Similarly, non-executive / sleeping directors are just as responsible as the 'main' director(s).

Do I have to attend court?

You are under no obligation to do so.
